Trading Hours for Distributors and Delivery of Liquor

This practice note is issued to clarify how the National Liquor Authority (NLA) within the Department of Trade and Industry will implement the Norms and Standards and Regulation 21 of Liquor Amendment Regulations of 2013 in relation to the trading hours for distributors.

The National Liquor Norms and Standards came into effect on the 13 February 2015 and prescribed the trading hours for distributors as follows:

TYPE DAYS HOURS:

Distribution Monday - Saturday 06:00 - 18:00

Sunday including Public Holidays 09:00 - 17:00

Regulation 21 of Liquor Amendment Regulations came into effect on the 11 May 2015 after the expiration of the suspension and has different trading hours from the one prescribed by the National Liquor Norms and Standards. In terms of the preamble of the National Liquor Norms and Standards:

“Where national and provincial regulations are not aligned to Norms and Standards such that the two are contradictory, the National Liquor Norms and Standards should prevail” The trading hours as prescribed by the National Liquor Norms and Standards will be applicable for the distribution of liquor within South Africa.

The Department of Transport is responsible for regulation of transportation in South Africa that includes public transport, civil aviation, shipping, freight and motor vehicles. Anyone transporting liquor must comply with the transportation rules and regulations as well as and in addition to any other relevant laws. Transportation of liquor can be done at any time allowed by the transportation regulations and the trading hours above are applicable to the physical delivery of liquor.

Therefore liquor products cannot be delivered outside the prescribed trading hours
